Nu-Kitchen's Terms and Conditions.

Confidentiality

 

Information furnished by Nu-Kitchen to "You", the user of www.nu-kitchen.com or customer of Nu-Kitchen, is intended for your sole and exclusive use and shall be considered proprietary information, ownership of which shall remain with Nu-Kitchen. You shall be fully responsible for maintaining confidentiality of account access information and for all charges made to your account.

 

 

Billing

 

Fees

 

You agree to pay Nu-Kitchen the fees as stated on www.nu-kitchen.com, in other official promotional material from Nu-Kitchen, or by a Nu-Kitchen sales representative in return for Nu-Kitchen products or services. Charges will be calculated based upon prices as stated by any of the above sources, plus applicable taxes. Nu-Kitchen reserves the right to withhold delivery of any product or service until it receives full agreed upon payment. Once a charge has been processed to your credit card account, you shall not request your credit card company to reverse the charge or charge it back to Nu-Kitchen. Pricing may change without notice and delivery fees may apply.

 

Order Cancellations

 

If you are not satisfied with Nu-Kitchen’s product or service offerings within the first three days of service, you may request a refund for the unused portion of your order without an early termination fee. If you decide to cancel your order, you must do so in writing to info@nu-kitchen.com or by postal mail or courier to Attention: Nu-Kitchen, 300 Welsh Road, Building 1, Suite 100, Horsham, PA 19044. In your request, you must state the effective date of your cancellation and the specific reason for the cancellation request. Nu-Kitchen will issue credits to the payment method on record provided by you within ten (10) business days of Nu-Kitchen’s receipt of your order cancellation request. You agree to pay any charge back costs incurred by Nu-Kitchen related to reversed charges on your account. Such costs may exceed the cost of the reversed item or charge back.

 

Delivery Cancellations

 

You are entitled to cancel (postpone) any delivery in full or in part, to be delivered on another future date. There are no fees or penalties associated with full day cancellations. Delivery cancellations will be accepted (1) through the My Account section of www.nu-kitchen.com no less than 24 hours before 7 a.m. on the date of the delivery in question; (2) by sending a request to info@nu-kitchen.com no less than 24 hours before 9 a.m. on the date of the delivery in question; or (3) by calling Nu-Kitchen Client Satisfaction at 1-212-582-1144 no less than 24 hours before 9 a.m. on the date of the delivery in question NOTE: Meals ordered for Saturday or Sunday will be delivered on the preceding Friday. Therefore, delivery cancellations related to orders intended for consumption on Saturday or Sunday must be received by the stated means and times on the preceding Thursday.

 

You will receive a point value for any cancelled deliveries. The point values for cancelled deliveries are as follows:

 

• 1.0 point for each full delivery cancelled. A full delivery includes (1) breakfast item; (1) lunch item; (1) dinner item; and (2) snack items.

• 0.2 points for the cancellation of any breakfast item, lunch item or dinner item.

• 0.1 points for the cancellation of any snack item.

 

For every 1.0 point you accumulate, you are entitled to (1) full delivery. One full delivery will be automatically added to your current order when you accumulate 1.0 point, and then that 1.0 point will be automatically deducted from your point balance. That additional full delivery will be scheduled for the next day in your defined delivery schedule following the upcoming scheduled deliveries that are part of the current order. Partial point balances are applied to your next order. No additions are made to your current order for partial point balances. No monetary payment or refund will be made for any points.

 

Quality Guarantee

 

Nu-Kitchen guarantees the quality of its products and service. If you do not receive a delivery or any individual item or item(s) within a delivery; if you received the wrong item(s) as part of a delivery; or if you are dissatisfied with the quality of any item(s), you may be entitled to a credit or other adjustment. In the case of incorrect items delivered or items of that are otherwise unsatisfactory due to production factors under the control of Nu-Kitchen, Nu-Kitchen reserves the right to request the items to be returned to Nu-Kitchen along with the packing slip for the delivery in question, and, based on the review of these items, Nu-Kitchen reserves the right to determine the appropriate remediation, if any, related to the matter.

 

Nu-Kitchen Property

 

Nu-Kitchen makes all deliveries in a reusable cooler bag with ice gel packs, all of which is the property of Nu-Kitchen. You must leave these items to be picked up by Nu-Kitchen in the place where your next delivery is to be made, no later than 11 p.m. the day before your next delivery. You must pay a $30.00 deposit for the use of these items, refundable to you no more than ten (10) business days after the last delivery of your order. Nu-Kitchen will automatically come to your delivery address between 11 p.m. and 6 a.m. the next weekday following your last delivery to pick up any bags and ice gel packs in your possession. You agree to leave all Nu-Kitchen bags and gel packs for retrieval at that time and location. Nu-Kitchen reserves the right to retain your deposit and charge you $30.00 for every additional bag that you fail to return to Nu-Kitchen more than ten (10) business days after your last delivery.

Indemnity

 

While Nu-Kitchen makes an effort to monitor food restrictions and aversions, it cannot guarantee that food items will not contain these restricted items. In particular with regard to nut allergies we cannot guarantee the complete absence of nut products or traces of nuts. Therefore, you warrant and represent that you will conduct a diligent inspection of all food items received from Nu-Kitchen. You also warrant and represent to ascertain if any items which are restricted or against which you have an aversion are present in the food, in which case you hereby agree to inform Nu-Kitchen without undue delay.

 

You agree to release Nu-Kitchen from any harm or injury that may arise if a restricted food is present and consumed. You, on behalf of yourself, heirs, executors, representatives, administrators and permitted assigns, hereby waive, release and forever discharge Nu-Kitchen, its affiliated-parent-subsidiary corporations/ business ventures and its/their shareholders, directors, officers, employees, agents, representatives, predecessors, successors and assigns (the “related parties”) completely from any and all claims, actions, rights, demands, liabilities and causes of any action of every kind and character, known or unknown, matured or unmatured, which you had or now have, arising from or relating to food restrictions and aversions, including allergic reactions.

 

Neither Nu-Kitchen, its experts, partners, members, managers, affiliates or employees will be liable for any direct, indirect, consequential, special, punitive, exemplary or any other damages which may result from the use of its products or services. This includes, without limitation, economic loss, injury, illness or death. No warranties or representations whatsoever are provided or to be construed or inferred regarding the effectiveness of our products or services.

 

Nu-Kitchen is in no manner responsible for the improper utilization, storage, handling or consumption of our products.

 

You agree to defend, indemnify, and hold Nu-Kitchen, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.

 

 

Product Disclaimer

 

Please be advised that no statement regarding Nu-Kitchen’s products has been evaluated by the Food and Drug Administration. Nu-Kitchen's products are not intended to diagnose, treat, cure or prevent any disease nor are they intended to treat specific health problems or medical conditions. Nu-Kitchen's products or services are not intended as a substitute for medical care from a qualified medical practitioner.

 

You are advised to regularly consult with your medical practitioner on any and all matters pertaining to physical and/or mental health including, without limitation, the experience of any symptoms which may require medical diagnosis or attention.

Site Availability

 

You acknowledge that it is technically impossible to provide the Site free of faults and that we do not undertake to do so; that faults may lead to the temporary unavailability of the Site; and that the operation of the Site may be adversely affected by conditions and performances outside our control, including, without limitation, transmission and telecommunications links between us and you and between us and other systems and networks.

 

 

Third Party Sites

 

Nu-Kitchen may provide links to third-party web sites on the Site. Nu-Kitchen also may select certain sites as priority responses to search terms you enter and Nu-Kitchen may agree to allow advertisers to respond to certain search terms with advertisements or sponsored content. Nu-Kitchen is not responsible for the content of linked third-party sites, sites framed within the Nu-Kitchen Site, third-party sites provided as search results, or third party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites.

 

 

Changes

 

We reserve the right to change these terms and conditions at any time. By continuing to use the Site or by continuing to accept our products and services following such change you will be deemed to have accepted such changes. It is your responsibility to check regularly to determine whether these terms and conditions have been changed. If you do not agree to any such change you must immediately contact Nu-Kitchen to cancel your current orders and stop using the Site.
